Spanish Nationality


Spanish nationality can be obtained by means of one's origin, by choice or residence.

1. Who are Spanish by means of origin?
People born of a Spanish mother or father.

People born in Spain of foreign parents, if at least one parent was also born in Spain. People born in Spain of foreign parents if neither of them has Spanish nationality.

People born in Spain and whose filiation is not determined. Foreigners under 18 adopted by Spaniards acquire Spanish nationality by means of origin, that begins with the date of the adoption.

2. Acquisition of Spanish nationality by means of residence in Spaina) Who can obtain Spanish nationality?
Any foreigner legally established as a resident in Spain can apply for Spanish nationality.

b) What does he need?
He has to prove that he has been residing in Spain for a determined period of time which is according to the nationality or other personal circumstances, please consult us.

3. Acquisition of Spanish nationality by means of consolidation: what does it mean? Those who have held a Spanish nationality for ten years and have used it correctly and in good faith, pursuant to a rule inscribed in the Register, can acquire the Spanish nationality.

a) What is necessary?
People concerned must have maintained an active attitude in the possession and use of Spanish nationality, meanings that they have behaved considering themselves Spanish, both benefiting of their rights and doing their duty towards Spanish State.

b) What does the Spanish nationality involve?
The right of obtaining the Spanish nationality, having originally another nationality.

c) Who can apply for the Spanish nationality?

That person whose birth would be determined in Spain after being 18 years old.

People in current or past charge of a Spaniard.

Those people whose mother or father was originally Spanish and was born in Spain.

Person over 18 who has been adopted by a Spaniard.

II. LOSS OF SPANISH NATIONALITY OR SPANISH CITYZENSHIP
1. How is Spanish nationality lost?

a) Spanish nationality is lost by emancipated people who while habitually living abroad: voluntarily acquire another nationality or, exclusively use the foreign nationality they had before emancipation. Loss of nationality will be effective after a period of three years, counting from the moment of acquisition of a foreign nationality or emancipation.

Those wanting to avoid the loss of nationality, must declare they want to preserve it.

a.1) The acquisition of Latin American nationality or nationality of Andorra, Philippines, Ecuatorial Guinea or Portugal, does not imply the loss of Spanish nationality.

b) In any case, emancipated Spaniards who specifically renounce to their nationality will loss Spanish nationality if they have another nationality.

c) People who are not Spanish by means of origins, also lose their nationality when:

Final judgment convicted them to lose it.

They voluntarily join armies or hold political jobs in a foreign country against the expressed prohibition of the Government.

When, for a period of 3 years they make use of the nationality to which they had said to have renounced when they acquired the Spanish nationality.

2. Can Spanish nationality be recovered?
a) It is possible if the following requirements are met:

Being a legal resident in Spain. (This requirement can be excused).

Declaring before the person in charge of the Register, the person’s wish to recover Spanish nationality.

Registering the recovery of the Spanish nationality in the Civil Register.
b) A previous authorization from the Government is necessary to recover the nationality in the following cases:

Those who make exclusive use of the nationality they had renounced when they acquired the Spanish nationality.

Those who voluntarily join the army or hold political jobs in a foreign country against the expressed prohibition of the Government.

When the loss of nationality was declared by final judgement. . Consult us
