Residence Permits


1 Circumstances under which a foreigner can stay in SpainForeigners can stay in Spain
under different circumstances. They can be on a stay situation or can be granted a temporary or permanent residence. Besides, there are some special regimens:

a) Stay situation: It is the authorization to stay in Spain for a period superior to ninety days. Visas and endorsements.

b) Residence: foreigners who are holders of a residence permit.. It can be:

Temporary, foreigner is authorized to stay in Spain for a period superior to 90 days and inferior to 5 years.

Permanent, it implies living and working in Spain indefinitely with the same rights as the Spaniards. This permit is granted to foreigners who can prove a five year legal and continuous residence in Spain.

c) Students: Student Visa. A student is considered a foreigner coming to Spain with the only purpose of studying or undertaking research, training or a non lucrative job.

d) Stateless Person: The Home Secretary will recognise the situation of Stateless to those foreigners who lack nationality and fulfil the requirements established at the Convention relating to the Status of Stateless persons. They will be asked for the relevant documents.e) Illegal immigrants: Foreigner who turns up at the Home Office admitting that he cannot be identified by the Authorities of any country.

f) Refugees: It can be granted following the petition of the Refugee Status.g) Under special circumstances: people with humanitarian reasons, those who co-operate with Administrative or Judicial Authorities or those who are under other special circumstances established by the Government.
